Privy Council Notes:
- 'Mr Attorney reports that the bill vests all charitable gifts in the bishop where no trustee is named expressly or where trustees refuse or neglect to execute the trust. It seems unreasonable and contrary to the intent of the donor and deprives the queen of appointing to what use general [?] charities shall be applied, and unnecessary, matters of charity being directions of the court of chancery. If the like bill were prepared as in England, for granting commissioners for charitable uses, such bill would be unreasonable and by the English statute the bishop of the diocese is always to be a trustee. My Lord Dartmouth is to write to my lord lieutenant upon it.' (13 Sept., PC 2/83, p. 308).
