Privy Council Notes:
- ‘Upon reading this day at the board the humble petition of Theobald, earl of Carlingford, Thomas, earl of Westmeath, Edward, Lord Viscount Mountgarrett, George Butler, esquire, John Malpas, esquire, Henry Seagrave, esquire, and John Reilly, esquire, in behalf of themselves and the rest of his majesty’s Roman Catholic subjects in Ireland, setting forth that a bill hath been lately transmitted ... which bill (if passed into a law) the petitioners apprehend will very much prejudice and affect them, and therefore humbly pray to be heard by their counsel against the same before it receives his majesty’s royal approbation.’ Petition referred to committee ‘to hear the petitioners thereupon and report what they conceive fit to be done therein’. 22 Dec. 1731. (PC 2/91, pp 516-17).
Committee ‘this day took into consideration ... together with the report of Mr Attorney and Solicitor General thereupon and heard counsel upon the petition of the Earl of Westmeath & als in behalf of the Roman Catholics of Ireland against the said bill, as also counsel in support of the bill. And their lordships directed Mr Attorney and Solicitor General to take back the said bill and consider about altering some of the clauses contained therein.’ 28 Dec. 1731. (PC 2/91, p. 527).
Committee reports that they ‘have met and considered of two bills’ ... ‘and have also heard counsel in support of the said bills as likewise in behalf of the Roman Catholics of Ireland against the same and do thereupon agree humbly to report to your majesty as their opinion that both the said bills are proper to be passed with some alterations, vizt.:’. 1 Feb. 1731[2].
